Employer compliance and LMIA checks: what workers should keep on file

Compliance inspections put the burden of proof on employers, but workers carry the consequences. Keep these records from day one of an employer-specific permit.

The situation

Employment and Social Development Canada inspects employers who hire through the Temporary Foreign Worker Program. Findings can affect an employer's ability to hire and, indirectly, a worker's permit renewal.

What to keep

Your signed employment contract, the job offer that matched the labour market impact assessment, pay stubs, and any written change to hours, wages or duties.

If conditions do not match

A worker on an employer-specific permit who faces abuse may be eligible for an open work permit for vulnerable workers. That route exists precisely because leaving the job would otherwise end status.

Our reading

Document everything in writing. Verbal changes to your role are the single most common gap when a permit renewal is reviewed.
